Nassau County Multiple DWI Lawyer

Former Nassau County Prosecutors Defending Felony DWI Charges in New York

A second or subsequent DWI charge in New York isn’t a repeat of your first case. It’s a felony prosecution, and the consequences scale accordingly. At Collins McCloskey Gann PLLC, our partners are former Assistant District Attorneys of Nassau County. We know how local prosecutors build repeat DWI cases because we built them. That background directly shapes the defense strategy we develop for every client facing an escalated charge.

Since 1990, our attorneys have brought over 80 years of collective experience to criminal defense representation across New York. If you’re searching for a 2nd DUI attorney in Nassau County, you need counsel who understands the full picture: the statutory penalties, how these cases move through local courts, and where the prosecution’s case may have vulnerabilities.

Call us at (516) 218-5131 to schedule a free case evaluation. The earlier you have experienced counsel in your corner, the more options you may have.

New York Penalties for a Second or Subsequent DWI Conviction

Under New York’s Vehicle and Traffic Law Section 1192, a second DWI conviction within 10 years of a prior conviction is charged as a Class E felony. That’s a significant escalation from a misdemeanor first offense. General statutory ranges under New York law include fines of $1,000 to $5,000, up to four years in state prison, and a mandatory minimum of five days in jail (which a judge may replace with 30 days of community service). A second conviction also carries a minimum one-year license revocation, extended to 18 months for a second Aggravated DWI conviction.

A third or subsequent DWI within the 10-year look-back period is a Class D felony, carrying up to seven years in prison and fines of $2,000 to $10,000. The look-back period for DWAI or Aggravated DWI is five years. Three or more alcohol- or drug-related driving convictions or refusals within 10 years can result in permanent license revocation, with a waiver request permitted only after five years.

Beyond court-imposed fines, all alcohol-related convictions carry mandatory state surcharges: $395 for misdemeanors and $520 for felonies. Under Leandra’s Law, any DWI conviction requires installation of a court-approved ignition interlock device on every vehicle you own or operate.

How a Felony DWI Case Moves Through Nassau County Courts

Because a second or subsequent DWI is prosecuted as a felony, it follows a different path than a misdemeanor charge. Arraignment typically occurs at Nassau County District Court (First District Court) in Hempstead, which handles criminal arraignments countywide. From there, the case is presented to a grand jury. If an indictment is returned, the matter transfers to Nassau County Court in Mineola for further proceedings.

That two-courthouse path gives a well-prepared defense team multiple points of intervention before a case reaches trial. Knowing how Nassau County prosecutors evaluate and present these matters at each stage isn’t something you pick up from a statute book.

Conditional License Eligibility After a Prior Conviction

Driving privileges are one of the most immediate practical concerns our clients raise. Under New York law, a driver with a prior DWI or DWAI conviction within the past five years is generally ineligible for a conditional license, both while the new case is pending and after conviction. A chemical test refusal at the time of arrest independently disqualifies a driver from conditional license eligibility.

Restoring full driving privileges after a felony DWI typically requires completing the Impaired Driver Program and meeting all DMV reinstatement requirements, in addition to any ignition interlock and program conditions the court imposes. Understanding this timeline early helps our clients plan realistically for what lies ahead.

Defense Strategies for Multiple DWI Cases

No two repeat DWI cases are identical. Our attorneys examine every layer of the prosecution’s case before recommending a course of action. Common areas of inquiry include:

  • Legality of the traffic stop: Whether the officer had sufficient legal basis to initiate the stop in the first place
  • Chemical test procedures: Calibration records, administration protocols, and chain of custody for breath or blood test results
  • Field sobriety testing: Whether standardized procedures were followed and whether environmental or physical factors affected the results
  • The prior conviction itself: The validity and timing of the conviction used to elevate the new charge to a felony can be examined and, in some circumstances, challenged

Depending on the facts, it may also be possible to negotiate a reduction from a DWI to a DWAI through a plea agreement. As multiple DUI attorneys serving Nassau County clients, our goal is to pursue the outcome that best protects your freedom, your record, and your future.
