How New York Charges Drug Distribution
New York doesn’t have a standalone “drug distribution” statute. This conduct is prosecuted as Criminal Sale of a Controlled Substance under Penal Law Article 220, and every degree of the charge is a felony. Even the sale of a small quantity triggers felony exposure, not a misdemeanor.
The degree of the charge depends on the type of controlled substance under the state’s Controlled Substance Schedules, the weight involved, and the circumstances of the sale:
- Fifth Degree (Class D Felony): The lowest-tier sale charge, but still a felony with potential prison time
- Fourth Degree (Class C Felony): Triggered by larger quantities or certain drug types
- Second Degree (Class A-II Felony): Involves significant quantities of serious controlled substances
- First Degree (Class A-I Felony): The most serious sale charge under the statute, reserved for the largest quantities
Selling on or near school grounds, a child day care facility, or to a minor can elevate the charge to a more serious degree. Actual sentencing exposure depends on case-specific facts and criminal history, which is why an early evaluation matters.
What Happens After a Drug Distribution Arrest in Nassau County
After an arrest, your case moves through a defined sequence before it ever reaches trial. Understanding that process helps you act quickly and strategically.
Arraignment at Nassau County District Court
Initial arraignment takes place at Nassau County District Court in Hempstead, where a judge reviews the charges, addresses bail, and may issue orders of protection. This is one of the earliest opportunities for our defense team to intervene on your behalf.
Grand Jury Presentation & Indictment
From arraignment, felony charges must be presented to a Grand Jury, which decides whether to return an indictment. If indicted, the case transfers to Nassau County Court in Mineola for further proceedings and, if necessary, trial. Each stage presents opportunities to challenge the charges and work toward the best available outcome.
Defense Strategies Against Sale & Distribution Charges
Our attorneys have litigated drug cases in both state and federal criminal courts, resolving matters through dismissal, negotiation, and verdict. The right defense depends on the facts, but several avenues commonly arise in these cases:
- Probable Cause & Search Warrant Challenges: If police lacked a valid warrant or sufficient probable cause for the search that led to your arrest, any evidence seized may be suppressible
- Chain of Custody Problems: Improper handling or transfers of seized drugs between evidence lockers can create gaps the prosecution can’t close
- Laboratory Confirmation: The substance must be confirmed as a controlled substance listed under the state’s schedules; lab errors or missing analysis create real vulnerabilities
- Intent to Sell: Prosecutors must prove intent to distribute. The absence of packaging materials, scales, or large amounts of cash can undercut that element
- Entrapment: When law enforcement or a cooperating individual induced a sale that wouldn’t otherwise have occurred, an entrapment defense may apply
Judicial diversion and drug treatment court programs may also be available depending on the circumstances, and we evaluate every option that could benefit our clients.
