Nassau County Uber & Lyft Accident Attorneys

Trial-Ready Representation for People Injured in Nassau County Rideshare Crashes

After an Uber or Lyft crash, the insurance analysis starts with a precise question: what was the driver doing in the app at the moment of impact? We assess whether the driver was offline, waiting for a request, traveling to a pickup, or transporting a passenger. That status can affect which personal, platform, or commercial policies apply.

We represent passengers, rideshare drivers, pedestrians, bicyclists, and occupants of other vehicles in New York personal injury cases. Our approach combines coverage analysis, medical documentation, preservation of app and trip data, insurer communications, and preparation for litigation when necessary.

How App Status Affects New York Rideshare Insurance

New York Vehicle and Traffic Law Article 44-B governs transportation network companies, including app-based services that connect riders with drivers. For covered trips outside New York City, including trips in Nassau County, insurance requirements change based on the driver’s activity in the digital network.

The two principal coverage periods are:

  • Logged in and waiting: Coverage must include at least $75,000 for bodily injury to one person, $150,000 for bodily injury to two or more people, and $25,000 for property damage. Uninsured motorist coverage and personal injury protection are also required.
  • Engaged in a prearranged trip: Coverage must include at least $1.25 million in liability insurance, $1.25 million in supplemental uninsured or underinsured motorist coverage, and personal injury protection.

Personal injury protection, often called no-fault coverage, can pay certain medical expenses and lost earnings without first establishing who caused the crash. Required financial responsibility may come from multiple policies, including a transportation network company group policy. Because available benefits and limits are fact-specific, the trip record and applicable policy documents require careful review.

Who May Bring a Rideshare Accident Claim

A rideshare collision can injure passengers, Uber or Lyft drivers, occupants of other vehicles, pedestrians, and bicyclists. Identifying who may bring a claim requires examining how the crash happened and which coverage was active.

A liability review may address:

  • The rideshare driver: Whether speeding, distraction, an unsafe turn, or another driving error contributed to the collision.
  • Another motorist: Whether a separate driver caused or shared responsibility for the impact.
  • Available insurers: Whether personal, transportation network company, uninsured motorist, or underinsured motorist coverage applies.
  • Shared fault: Whether responsibility should be divided among multiple people, which can affect the amount recoverable.

The rideshare company or its insurer may be relevant where legally applicable, but the presence of an Uber or Lyft vehicle doesn’t automatically establish liability. Driver conduct, vehicle involvement, app status, and policy language must be evaluated together.

Evidence That Can Strengthen a Rideshare Injury Claim

App and trip data can be as important as traditional motor-vehicle collision evidence. Relevant records may include the trip receipt, driver and vehicle details, app screenshots, photographs, police information, witness contacts, medical records, and communications with the platform or an insurer.

We evaluate how this evidence documents the collision, injuries, medical treatment, lost income, property damage, and available no-fault benefits. We may also need to address New York’s serious-injury threshold, which can limit when an injured person may seek compensation for pain and suffering through a negligence action.

Recorded statements, releases, and early settlement offers require caution. Before accepting an offer or signing documents, you should understand which claims and insurance benefits may still be available.
